How we enforce compliance

Not all suspected non-compliance may warrant enforcement action. The Greenhouse and Energy Minimum Standards Regulator encourages voluntary compliance and responds to non-compliance in a manner that is appropriate and proportionate to the risk posed by the non-compliance.

As a general principle, informal and administrative action will be used in response to first and less serious contraventions. This ensures that suppliers who have contravened the Greenhouse and Energy Minimum Standards Act 2012 are made aware of their obligations and provided with guidance to assist them to meet their obligations in the future. Where deliberate failure to comply is identified, these contraventions will be referred for formal enforcement action.

Formal enforcement action generally occurs when the regulated entity fails to comply voluntarily following informal action taken by the Greenhouse and Energy Minimum Standards Regulator.

Greenhouse and Energy Minimum Standards Regulator enforcement responses include:

  • suspending a model’s registration
  • cancelling a model’s registration
  • enforceable undertakings
  • infringement notices
  • civil penalty orders
  • injunctions.
