Declarations under section 27A of the Act

Section 27A of the Greenhouse and Energy Minimum Standards Act 2012 (Act) gives the GEMS Regulator authority to deem alternative requirements compliant with the Act. This is referred to as ‘deemed compliance’.

To do this the GEMS Regulator makes a legislative instrument (a declaration) that specifies classes of products, or models, can comply with alternative requirements that were not originally included in the determination. This may apply, for example, to test requirements or methods.

Before a declaration is made, the GEMS Regulator must be satisfied that the alternative requirement or method promotes the objects of the Act.

The alternative requirements approved by the GEMS Regulator do not apply in New Zealand.

Allows for the use of sodium percarbonate instead of sodium perborate tetrahydrate in the detergent used for testing. Includes requirements as to sodium percarbonate use including the dosing rate.

Testing still needs to occur before registering models.
