  1. Are excluded products also required to be registered?

    Answer: No. If your product qualifies as one of the listed exclusions in the determination, suppliers do not need to register. Only in scope products mentioned in that determination need to be registered.

  2. When will the GEMS determination for LED lamps will be implemented?

    Answer: If agreed by Energy Ministers, the determination will commence 12 months after the legislation is registered on the Federal Register of Legislation.

  3. Is there a process to allow suppliers of niche products to continue to import? What is the process?

    Answer: You will need to apply to the GEMS Regulator for an exemption by completing the Exemption Application and return it to the GEMS Regulator. Please note, exemption applications usually take a one month to process after we receive all the relevant information from you. If you are approved for an exemption, you must register the model and advise us that you received an exemption.

  4. How does GEMS Compliance conduct online compliance monitoring, in particular marketplaces such as Alibaba and eBay?

    Answer: Online market surveillance monitors third party websites selling direct to consumers in Australia to ensure that products which are in scope of the determination are registered correctly. Where online information is not sufficient to determine if that product is compliant:

    • the supplier will be contacted by the GEMS compliance team to confirm the product details
    • GEMS inspectors can engage the platform's compliance team to alert them of the non-compliant products that are being offered for sale and request that the products be removed.
  5. You mentioned supplier workshops – when will they occur?

    Answer: Two information sessions were held on 5 December 2024. Additional workshops will be held once we have confirmation of a determination – most likely in late February or early March 2025.

  6. Does it look like this regulation will expand past lamps in future to things such as integrated LED products like pendants/general lighting?

    Answer: All regulatory decisions go through a rigorous assessment process, from agreement to investigate regulation, consultation regulation impact statements to determine the costs/benefits of regulation, and decisions to regulate. This process would apply to any future consideration of extension of the scope of LEDs regulated under the GEMS Act.

  7. On product testing, are there any specific guidelines for products with adjustable power output? Which kW should we consider? Should we use the high setting or an average?

    Answer: The LED determination sets out details of the reference control settings for the testing of models with control features that allow the end user to adjust lamp characteristics that impact the energy performance of that model. In all cases the lamp must obtain full-load conditions when being tested.

  8. PAR38 are not excluded in the 2024 Incandescent Determination – can that be rectified? 

    Answer: The department is reviewing the current determination exclusions and will advise if any changes to the determination are required.

  9. Regarding the special purpose family, in the proposed LED determination, are test reports needed to be provided at time of registration?

    Answer: Yes, each model in the special purpose family will need to provide.
